A bidder must be excluded if the bidder, its representative, a member of its management or supervisory body, or another person who controls the undertaking or is authorised to make decisions on its behalf has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorism-related offence, money laundering or terrorist financing. Grounds for exclusion also include convictions for enabling unlawful employment, facilitating breaches of the conditions for employing a foreign national in Estonia, unlawful use of child labour or human trafficking. The bidder must have no outstanding national tax, duty or environmental charge debts, and no tax or social security contribution debts under the law of its country of establishment.
The contracting authority may exclude a bidder that has materially or repeatedly breached essential terms of a previous public contract, resulting in termination or withdrawal from the contract, a price reduction, compensation for damage or a contractual penalty. A bidder may also be excluded for providing false information about compliance with the selection requirements or for failing to provide required information or supplementary documents.
An undertaking established or resident in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have been worth €50,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from public or private databases without significant cost.
The bidder’s team must include:
- A person authorised to carry out switching operations on the 0.22–20 kV electricity network, excluding regional and distribution substations, and listed in Elektrilevi’s partner portal before the tender opening. For low-voltage works only (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The rights must be obtained in accordance with instruction J387.
- A person appointed to be responsible for the work operation, listed in Elektrilevi’s partner portal before the tender submission deadline. The applicable instructions are J31 and J3284.
- A person responsible for managing electrical works who, at the time of submission, holds valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act, has evidence of that qualification and is listed in Elektrilevi’s partner portal before the submission deadline.
The tender must comply with all procurement documents and must not be conditional. The bidder must submit the price using the prescribed table and complete every unit-price field. The bidder must identify and justify any trade secrets; prices and other evaluation-related figures may not be designated as trade secrets. The bidder must provide the names, titles and contact details of the contract signatory or signatories and the contract-performance contact person; evidence of authority to represent the bidder must be attached if it is not apparent from the Commercial Register. Joint bidders must appoint an authorised representative and provide a power of attorney.
The standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to €59,999, 35 calendar days for contracts from €60,000 to €249,999, and 45 calendar days for contracts of €250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days.
The installed or used materials, equipment and goods, including components, must not be produced in or originate from Russia or Belarus. The contracting authority may request certificates of origin.
