Compliance requirements
The exclusion grounds apply to all lots. The bidder must confirm that neither the company nor its management, administrative or supervisory body members or representatives have, in the past five years, been finally convicted of participating in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, illegal use of child labour, or human trafficking. Any exclusion period that remains in force also applies. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
A ground for exclusion also exists where the bidder has failed to meet its tax or social security contribution obligations in Estonia or in its country of establishment. The stated threshold for tax arrears is EUR 0. Under the Estonian tax-law explanation, however, a tax-debt certificate is not issued for arrears below EUR 100 or where payment has been deferred. Tax arrears of a foreign bidder are assessed under the law of its country of establishment. The bidder may provide information about how the breach was established and whether it has been remedied or paid.
The bidder must also confirm that awarding the contract would not breach an international sanction or a sanction imposed by the Government of the Republic of Estonia. If there is a justified doubt, the contracting authority may request further information or evidence to check this ground.
Qualification criteria and exclusion grounds
The bidder must submit the participation application using Annex 3, Form II and hold an Estonian licence for wholesale trade in medicinal products. The offered medicine must have a valid marketing authorisation in Estonia; the bidder must confirm this in the application. The contracting authority will check both licences in the relevant registers. If a medicine lacks an Estonian marketing authorisation or a specialist society’s application, the contracting authority will apply to the Medicines Agency for its import.
For each lot, submit Annex 1 in Excel format, stating the active substance, original product name, pack size, unit and strength, dosage form, manufacturer, pack price, unit price and total price. Submit the lot’s total price excluding VAT in euros, using the required price-form structure. Prices must include all delivery and unloading costs to the hospital pharmacy at L. Puusepa 8, Tartu; quoted unit prices are final, with no additional charges. Bids may be submitted for up to 27 lots.
The bid must confirm compliance with the tender documents. Where an equivalent product or standard is offered, explain the equivalence and provide supporting evidence; other suitable evidence may be accepted where the stated legal conditions allow it. Confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or established in Russia, are more than 50% owned by such persons or entities, or act on their behalf or under their instructions.
For a joint bid, appoint an authorised representative and submit the power of attorney and confirmation of joint and several liability using Annex 3, Form I. Identify any claimed trade secrets and explain the basis; the bid price and other figures used for evaluating goods bids may not be designated as trade secrets. The documents provided do not specify detailed award scoring or weighting; check the official tender documents for those details.
