Compliance requirements
A bidder may be excluded if, within the last five years, the bidder or a person representing, managing or supervising it has been finally convicted of participation in a criminal organisation, corruption, fraud, terrorist offences or related activity, money laundering or terrorist financing, the illegal use of child labour, or human trafficking, or remains subject to an exclusion period imposed by a judgment. Where permitted by law or the tender documents, the bidder may provide evidence of measures taken to restore its reliability.
Grounds for exclusion also include failure to meet tax or social security contribution obligations. The stated threshold is EUR 0; the notice explains that Estonia does not issue a tax debt certificate where the debt is below EUR 100 or payment has been rescheduled. For foreign bidders, the rules of their country of establishment apply.
A bidder may also be excluded if awarding the contract would breach an international sanction or a sanction imposed by the Government of Estonia, or if the bidder or a person representing, managing or supervising it has been penalised for allowing a foreign national staying in Estonia without legal grounds to work, or for breaching the conditions of a foreign national’s employment in Estonia, including paying less than the statutory wage rate.
