Compliance requirements
The contracting authority will exclude a bidder if any mandatory ground under § 95(1) of the Estonian Public Procurement Act applies. It may also exclude a bidder under § 95(4)(8) or § 95(4¹). The bidder must confirm that none of these grounds apply.
The bidder must also confirm that it is not subject to a restriction on submitting a bid or request to participate based on its place of residence or registered office, as described in § 95(4)(12) and § 7(3) of the Act. Any specific restriction set by the contracting authority is to be checked in the tender documents.
Qualification criteria and exclusion grounds
The provider must hold a valid activity licence issued by the Health Board for providing occupational health services and maintain it continuously throughout the contract. The provider must state the licence number; if the licence cannot be verified in the Health Board’s public register, a copy must be submitted at the contracting authority’s request. Any subcontractor directly involved in delivering the services must also hold a valid licence.
During the 36 months preceding the start of the procurement, the bidder must have completed at least one occupational health services contract under which health examinations were carried out for at least 500 employees. For a contract concluded earlier or still in force, the bid must state the number of employees examined and the value of the work completed during that 36-month reference period. Submit the list of qualifying contracts using tender document Form 2, completing all its fields.
Services must be provided in Tallinn; provide the addresses of the service locations. State the name of the occupational health physician who will perform the contractual duties.
Joint bidders must register as such in the procurement register, appoint an authorised representative and submit the power of attorney using Form 1. The bid must include confirmation that exclusion grounds do not apply to each joint bidder, and describe the size and nature of each joint bidder’s share of the contract.
The bid must accept the tender document and framework agreement terms; conditional bids are not permitted. Submit prices in the structure specified in the pricing criteria and provide unit prices using Form 3, completing all required rows and columns without changing the designated white-background rows or columns. The bidder must identify any trade secrets and explain why the information qualifies, or state that the bid contains none. The bid must be submitted by a person with legal authority to represent the bidder or by an authorised representative; where applicable, include a digitally signed power of attorney. If subcontractors are intended, identify them in the procurement register and submit Form 4.
