Compliance requirements
The bidder must declare whether any exclusion ground applies to it or, where relevant, to its representatives. Grounds include convictions within the last five years, or a continuing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest or an unfair advantage arising from involvement in preparing the procurement; significant or repeated failures under previous contracts resulting in early termination, damages or similar sanctions; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information; and breaches of environmental, social or labour-law obligations. National grounds also cover enabling the unlawful employment of a foreign national, being subject to international sanctions, and convictions for tax offences. The stated tax-debt threshold is zero; the notice explains that an Estonian tax-debt certificate is not issued where the debt is below EUR 100 or payment has been deferred. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have, employed or engaged under another contractual arrangement throughout the contract, a maintenance engineer or technician trained by the manufacturer to install, commission, maintain and repair the offered equipment. The bidder must provide the person’s details in the ESPD and submit a copy of the training certificate. The bidder must also have a person trained by the manufacturer to deliver the training specified in section 4.1 of Annex 1; provide that person’s details in the ESPD and submit a copy of the manufacturer-issued training certificate.
The bidder must be the authorised representative for the offered equipment and submit evidence of representation rights granted by the manufacturer or, where the manufacturer is outside the European Union, by its authorised representative. Any further authorisations in the chain must also be documented. The offered equipment, including the artificial ventilation unit, must bear CE marking and comply with Regulation (EU) 2017/745, or have a marketing authorisation issued by the State Agency of Medicines valid for the equipment’s entire service life. Submit the relevant declarations of conformity, certificates where applicable, or marketing authorisation.
The offer must include the technical proposal in the format of Annex 1, submitted in Word format; manufacturer-issued technical data and/or an instruction manual demonstrating compliance with all technical requirements in Annex 1; and maintenance plans for the warranty and post-warranty periods specifying the frequency of scheduled maintenance, the work involved and the time required. Prices must be entered in the specified structure, separately stating the equipment package price excluding VAT, the price excluding VAT for nine years of post-warranty preventive maintenance, and the repair-work hourly rate excluding VAT. The equipment package price must include delivery, installation, commissioning, training, full maintenance during the warranty period and other specified obligations; prices must be final, with no additional charges.
The bidder must submit the participation declaration using Form II. Joint bidders must appoint an authorised representative and submit the power of attorney and confirmation of joint and several liability using Form I. The offer must identify any trade secrets and explain why they qualify, without treating the offer price or other specified evaluation figures as trade secrets. The bidder must confirm that the offered goods are not subject to international sanctions and are not from sanctioned regions. Sanctioned Russian-linked subcontractors or suppliers must not account for more than 10% of the contract value. The offer must comply with the procurement documents; where equivalence is relied upon, explain it and provide supporting evidence. No specific award-scoring method is stated in the available documents.
