Compliance requirements
A tenderer may be excluded if it, a member of its administrative, management or supervisory body, or a person authorised to represent, make decisions for or control it has received a relevant final conviction within the previous five years, or remains subject to an exclusion period. The listed offences include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and the unlawful use of child labour or other forms of human trafficking. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability. Exclusion grounds also include breaches of tax or social-security payment obligations. For Estonian tax debts, the notice states that a certificate is not issued where the debt is below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled; foreign tenderers are assessed under the law of their country of establishment. A tenderer may also be excluded if awarding the contract would breach an international or Estonian government sanctions measure. The offered goods must not be subject to international sanctions or originate from sanctioned regions. For procurements at or above the international threshold, the tenderer must not involve, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals, residents or entities established in Russia, entities more than 50% directly or indirectly owned by them, or persons or entities acting on their behalf or under their direction.
