Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder must be excluded if the bidder or a member of its representative, management or supervisory body has been convicted of participating in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Grounds for exclusion also include convictions for enabling illegal employment, breaches of rules on the employment of foreign nationals, or offences related to the unlawful use of child labour or human trafficking. A bidder with outstanding tax debt must also be excluded. The contracting authority may exclude a bidder that has materially or repeatedly breached a previous public contract, resulting in termination or withdrawal from the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may also apply if the bidder has provided false information about meeting the qualification requirements or failed to provide required information or documents. The bidder must confirm that none of the mandatory or discretionary grounds for exclusion apply to it.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must provide a list stating the contract performance period, the other contracting parties’ details (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference numbers. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from public or private databases without significant cost. The bidder must have an electrical works manager with a valid A-class competence and/or a qualification of at least level 6 under the Professions Act, with the relevant evidence in place by the tender submission deadline. This person must be registered in the Elektrilevi Partner Portal (EPP) before tenders are opened. The bidder must also have a worker authorised to carry out switching operations related to the works in 0.22–20 kV electrical networks, excluding regional and distribution substations, registered in EPP before tenders are opened. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where medium-voltage switching is needed for low-voltage works. The bidder must also have a person appointed as responsible for the work operation, registered in EPP before tenders are opened. The relevant training and authorisation procedures are set out in the referenced Elektrilevi documents. The tender must include the completed price table in the form provided in the procurement documents, with every unit-price field filled in, and must take account of the instructions for completing management system document V178. The bidder must provide the name, position and contact details of the contract signatory or signatories and appoint a contact person for contract-related matters. If the signatory’s authority does not arise from the articles of association, a power of attorney must be included. The bidder must confirm that its place of residence or establishment is not in Russia or Belarus. Materials, equipment and goods installed or used in the works, including components, must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The standard payment period is 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. If the bidder joins the contracting authority’s factoring programme, the payment period is 95 calendar days. No award criteria are specified in the provided documents.
