Compliance requirements
A bidder may be excluded if it, or a member of its management, supervisory or administrative body, or an authorised representative, has received a relevant final conviction within the past five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. Other grounds include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation, administration of assets by a liquidator or court, suspension of business or a comparable situation; serious professional misconduct; agreements intended to distort competition; an unresolved conflict of interest or involvement in preparing the procurement that creates an unavoidable competitive advantage; and serious or persistent failures under earlier contracts resulting in early termination, damages, a price reduction or penalties. A bidder may also be excluded for providing false or misleading information, withholding required information or documents, failing to provide requested supporting documents, or improperly seeking confidential information that could provide an unfair advantage. National grounds include enabling a foreign national without a legal basis to work in Estonia, being subject to an international sanction that would make the contract unlawful, and relevant convictions for tax offences. Where permitted by law or the tender documents, a bidder may provide evidence of measures taken to restore its reliability.
