Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

Exclusion may apply if the bidder, or a member of its management, governing or supervisory body or an authorized representative, has a relevant final conviction within the last five years or remains subject to an exclusion period. The listed offences include participation in a criminal organization, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include tax or social-security payment arrears; bankruptcy, insolvency, liquidation, administration of assets by a liquidator or court, suspension of business, or comparable proceedings; serious professional misconduct; breaches of environmental, social or labour obligations; agreements intended to distort competition; an unavoidable conflict of interest; involvement in preparing this procurement that creates an advantage which cannot otherwise be neutralized; and serious or persistent failure to perform an earlier public contract resulting in termination, damages, a price reduction or a penalty. Exclusion may also apply for false or misleading information, withholding required information, failure to provide requested supporting documents, or improperly seeking confidential information or influencing the decision-making process. The listed national grounds also include enabling a foreign national to work without legal grounds or in breach of employment conditions, including payment below the statutory wage rate; a contract that would breach an international or Estonian government sanction; and conviction for tax offences. The tax-arrears note states that an Estonian tax certificate is not issued where the relevant debt, excluding interest not determined by an administrative act, is below EUR 100 or payment has been deferred. Where legally available, a bidder may provide evidence of remedial measures to demonstrate reliability.

Qualification criteria and exclusion grounds

The notice does not state separate financial, experience or other bidder qualification thresholds. Bidders may submit offers for up to 20 lots, and one bidder may be awarded up to 20 lots. The offer must be unconditional, comply with the tender documents and use the prescribed pricing structure. It must include the completed technical-description and offer form, the required contact details for the contract signatory and contract-performance contact, manufacturer-issued technical documentation for checking each offered product, and manufacturer documents confirming compliance. All products must bear the CE marking, comply with Medical Device Regulation (EU) 2017/745 and be free of DEHP. Equivalent products may be offered, with an explanation and supporting evidence where needed. Following the contracting authority’s request, product samples in the quantities specified for the relevant lot must be submitted for testing within 5 working days; the deadline may be extended by agreement. Samples must be in sealed, marked packaging. Offers may be rejected if samples are late, incomplete or fail functional testing. Submitted samples will not be returned. The contracting authority may request additional samples and pay for them at the offered unit price if the order is fulfilled completely and on time. The bidder must declare any information in the offer that it considers a trade secret and give reasons; prices and price components, and specified evaluation-related figures, may not be classified as trade secrets. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. For procurements at or above the international threshold, the bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers linked to Russian nationals, residents or entities established in Russia, entities more than 50% owned by them, or persons acting on their behalf or instructions. The supplied documents do not specify the award-scoring method; check the official tender documents for details.
