Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if it, or a person authorised to represent, manage or control it, has a relevant conviction within the previous five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or human trafficking. Exclusion grounds also include unpaid taxes or social security contributions and the specified offence of enabling a foreign national to work unlawfully, including paying below the statutory wage rate. The bidder must also confirm that awarding the contract would not breach international or Estonian government sanctions. For tax and social security debts, the stated threshold is EUR 0; under the additional information, a tax-debt certificate is not issued for debts below EUR 100 (excluding interest not determined by an administrative act) or where payment has been rescheduled. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must be entered in the relevant business register in its country of establishment. To operate as an electricity seller, it must also have submitted a notice of economic activity to the Estonian Register of Economic Activities; the contracting authority will verify this in the register, and a missing record will make the tender non-compliant. The tender documents also require confirmation that the bid meets their conditions, follows the specified price-submission structure and is unconditional. Where equivalence is relevant, the bidder must explain it and provide supporting evidence. The offered electricity must not be subject to international sanctions or originate from sanctioned regions. In a joint bid, the bidders must appoint an authorised representative and provide the required power of attorney. The bidder must identify and justify any trade secrets, but may not designate the tender price or other specified evaluation-related figures as trade secrets. No specific turnover, experience or staffing threshold is stated.
