Compliance requirements
The contracting authority will exclude bidders subject to the statutory grounds, including convictions relating to participation in a criminal organisation, breach of trust or corruption, fraud, terrorism or related offences, money laundering or terrorist financing, unlawful employment or violations of foreign workers’ employment conditions, illegal child labour or human trafficking. Exclusion also applies where the bidder has outstanding tax, duty or environmental-charge liabilities under Estonian law, or tax or social-security liabilities under the law of its country of establishment, and where awarding the contract would breach an international or Estonian government sanction. For a bid involving a foreign company, provide evidence that the exclusion grounds do not apply to that company and the relevant representatives or persons with control; the authority may request further evidence where the information cannot be checked in a public register.
Qualification criteria and exclusion grounds
The bidder’s net turnover over its last three completed financial years must total at least EUR 360,000, with at least EUR 120,000 in each year. Within the 36 months preceding the start of the procurement procedure, the bidder must have properly performed at least three office-supplies contracts, each with a value of at least EUR 90,000 excluding VAT. For each reference, provide the contract subject, customer and contact details, contract period and value, together with customer confirmation of the subject, value and proper performance; confirmation is not required where the relevant facts are publicly verifiable in the public procurement register. If relying on another entity’s capacity, provide its signed commitment covering consent, participation in contract performance, relevant experience and joint responsibility. Foreign bidders or capacity providers must provide financial statements or other evidence enabling verification of turnover requirements.
The bid must include the completed price table with product names, descriptions or technical specifications, and unit prices and total price in euros excluding VAT. The required fields in the price table must be completed without substantive changes, and its total must match the total entered in the electronic bid. State a general discount, to a maximum of two decimal places, applying to products offered in the online ordering environment except products listed in the price table.
The bidder must confirm that the offered goods are new, unused, defect-free and compliant with the tender requirements, and provide evidence of equivalence where applicable. For the specified A3, A4 and Image Digicolor A4 (or equivalent) paper, provide an EU Ecolabel or equivalent ISO 14024 Type I ecolabel certificate, or an independent conformity audit demonstrating compliance with the relevant criteria. Provide the paper manufacturer’s details and evidence of an ISO 9001, ISO 14001 or EMAS quality or environmental management system, or an audit confirming an equivalent system. The primary wood fibre used for pulp must come from a legal source; evidence of origin is due upon delivery, and uncertified fibre must be traceable through the supply chain, with its type, quantity and origin specified.
The bidder must provide a power of attorney if the bid signatory is not its legal representative. Foreign bidders must provide company-register evidence of representation authority. Joint bidders must appoint an authorised representative, submit the joint-bidder authorisation and confirmation, and accept joint and several liability for contract performance. The bidder must also identify and justify any trade secrets, excluding prices and evaluation-related figures that cannot be designated as confidential. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers covered by the applicable Russia-related restrictions, and that the offered goods are not subject to international sanctions or from sanctioned regions.
