Compliance requirements
The bidder may be excluded for specified convictions involving the bidder or its relevant directors, managers, supervisors or representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The grounds also include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, comparable proceedings, court or liquidator control of assets, or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be neutralised; serious or repeated breach of an earlier public contract resulting in early termination, damages, a price reduction or a penalty; and false or misleading information, failure to provide required information or requested supporting documents, or improper attempts to influence the procedure or obtain confidential information. Additional national grounds cover enabling a foreign national to work without a legal basis or in breach of employment conditions, including paying below the statutory rate; being subject to an international or Estonian government sanction; and relevant tax offences. For taxes and social security contributions, the stated threshold is €0; under Estonian tax rules, a debt below €100 or a debt whose payment has been deferred is treated as specified in the tender-pass text. Where permitted, a bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have completed at least one similar contract within the 36 months preceding the start of the procurement. The contract must have covered organising a public event lasting at least two days and attended by at least 1,000 visitors; renting inventory and technical equipment, including power, sound, video, lighting and decorations, with installation and dismantling; and preparing and implementing the event’s communications plan. At least €50,000 excluding VAT must have been completed under the contract. The bidder must provide the contracting party’s name and contact details, the event name, date and duration, visitor count, contract value excluding VAT, and contract signature, completion and performance dates; a procurement reference number must also be provided if the contract resulted from a public procurement. For a partly performed or jointly performed contract, only the bidder’s own qualifying share and value count. A joint bid meets the requirement if one or more consortium members have completed the qualifying contract together. The contract may have been performed for a public- or private-sector client.
The bid must name a project manager and include the information requested in Form IV. The project manager must have led, as project manager or chief organiser, at least one public event lasting at least two days and attended by at least 1,000 visitors within the 36 months preceding the start of the procurement, and must be fluent in Estonian. The project manager may be the bidder’s employee or subcontractor; failure to name a qualifying project manager results in rejection.
The bid must include the required forms: Appendix 3 price form, Form II concept proposal, Form III participation application and Form IV project manager details. Form I, the consortium authorisation, is required for joint bids. The price must follow the prescribed structure, be greater than zero, include all costs of contract performance, and the total excluding VAT must match in the designated price documents. Conditional bids are not permitted. The bidder must confirm compliance with the tender documents and explain and substantiate any proposed equivalent solutions. The service proposal must include an initial festival concept with an event marketing concept, entertainment programme and opening ceremony concept; an idea for a youth-oriented interactive solution; a method for counting unique visitors; and an initial festival communications plan. The concept proposal is used in evaluation, but the detailed scoring method is set out in Appendix 4 and is not specified in the available text. The bidder must submit all required forms and confirm that they are complete and compliant.
