Compliance requirements

The bidder and its relevant representatives must declare whether, within the previous five years or while an exclusion period remains in force, they have been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour or human trafficking offences. Grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets by a liquidator or suspension of business; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot be resolved; involvement in preparing this procurement that creates an irremediable competitive advantage; and significant or repeated failures under previous contracts resulting in early termination, damages, price reductions or penalties. Exclusion may also apply for false or misleading information, failure to provide required information or documents, improper attempts to influence the procurement or obtain confidential information, enabling unlawful employment of a foreign national, international sanctions, or convictions for tax offences. The bidder may be asked to provide details and, where permitted, evidence of measures taken to restore its reliability. For tax debts, the notice records a threshold of EUR 0 and explains that, under Estonian rules, a certificate is not issued where the relevant tax debt is below EUR 100 (excluding interest not determined by an administrative act) or payment has been deferred; foreign bidders are assessed under the rules of their country of residence.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least one passenger transport service contract during the 36 months preceding the start of this procurement. The contract must have been worth at least EUR 20,000 excluding VAT. The bidder must provide a list of relevant completed contracts, including the contract period, value and client details, with a client representative’s contact details (including telephone number and email address); for public contracts, include the procurement reference number. The bid must confirm acceptance of all tender-document conditions and that the service will be performed as specified. Conditional bids are not permitted. If bidding jointly, the bidders must appoint an authorised representative and submit a power of attorney with the joint bid; each joint bidder must accept joint and several responsibility for contract performance. If relying on another entity’s resources to meet the qualification requirements, the bidder must submit that entity’s consent to participate in performing the contract. The vehicle used during contract performance must be no more than 15 years old, calculated from its year of manufacture. The driver must hold a driving licence of the appropriate category and have Estonian language proficiency of at least B1. Where the bid proposes an equivalent to a specified standard, mark or other requirement, explain the equivalence and provide supporting evidence where necessary. The bidder must confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers who are Russian nationals or residents, entities established in Russia, entities more than 50% directly or indirectly owned by such persons or entities, or representatives or persons acting on their instructions. The award criteria are not specified in the provided document extracts; check the official tender documents for details.
