Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the European Single Procurement Document apply to it or to its management, supervisory or representative persons. These include serious criminal offences such as participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, child labour and human trafficking; outstanding tax or social security contributions; breaches of environmental, social or labour law; insolvency or suspended business activities; serious professional misconduct, anti-competitive agreements, an unresolved conflict of interest, involvement in preparing the procurement resulting in an unfair advantage, and material breaches of previous contracts. Grounds may also include submitting false or misleading information, failing to provide required information or documents, or improperly obtaining confidential information.
National grounds are also checked: enabling a foreign national without lawful residence to work or breaching the conditions of their employment, a breach of international or national sanctions, and conviction for tax offences. The notice sets the threshold for tax and social security arrears at EUR 0; the additional information states that an Estonian tax-debt certificate is not issued for a debt below EUR 100 or where payment has been rescheduled. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
