Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that no mandatory exclusion grounds apply. These include relevant convictions of the bidder or persons authorised to represent, manage or control it for participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; specified offences involving the illegal employment or treatment of foreign nationals; child labour or human trafficking; and outstanding state taxes, duties or environmental charges, or tax or social security contribution arrears under the law of the bidder’s country. The contracting authority may also exclude a bidder for materially or persistently breaching an important term of a previous public contract where this led to termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder for providing false information about compliance with qualification requirements or failing to provide such information or requested supplementary documents. The bidder must confirm that these discretionary grounds do not apply.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 350,000 in each of the last three completed financial years. The bidder must provide extracts from the annual accounts showing turnover, unless the information is publicly available to the contracting authority from a register. At least six months must have elapsed since the end of the latest completed financial year as of the bid submission date. During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to this procurement; at least one contract must have a value of EUR 120,000 or more, excluding VAT. A list of contracts must state the performance period, details of the other contracting parties including the client representative’s telephone number and email address, and procurement reference numbers where applicable. Evidence of proper performance must be provided upon request unless the contracting authority can readily obtain it from databases. The bidder must have a suitably authorised switching operator listed in Elektrilevi’s partner portal before bids are opened. For works involving only low voltage (0.22–1 kV), low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The bidder must also have an electrical works supervisor with valid A-level competence and/or a qualification of at least level 6, holding the relevant evidence by the bid submission deadline and listed in the portal before bids are opened. A person appointed as responsible for the work operation must have valid rights and be listed in the portal before bids are opened. The bid must comply with the procurement documents and may not contain additional conditions. The price must be submitted using the required table, with every unit-price field completed. The bidder must provide the name, position and contact details of the contract signatory and the contract-performance contact person; a power of attorney is required if signing authority does not arise from the articles of association. The bidder must identify and justify any trade secrets, but may not classify the bid price or specified evaluation-related figures as trade secrets. The standard payment period is 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more, counted from receipt of the invoice. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Enterprises established in Russia or Belarus may not participate, and materials, equipment and goods, including components, originating from or produced in Russia or Belarus may not be installed or used; the contracting authority may request certificates of origin.
