The contracting authority may also exclude a bidder for breaches of environmental, social or labour obligations; bankruptcy, liquidation, suspended business or a similar status; serious professional misconduct; anti-competitive agreements or conduct; an unmanageable conflict of interest; an advantage arising from involvement in preparing the procurement; significant or repeated failures to perform previous public contracts; false or withheld information relevant to qualification or requested supporting documents; attempts to improperly influence the contracting authority or obtain confidential information, or negligent provision of misleading information; certain tax-related convictions; or lack of the legal right to submit a bid. The bidder must confirm that these grounds do not apply.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must provide extracts from the financial statements showing turnover for those years, unless the information is publicly available to the contracting authority in a register. If the financial year differs from the calendar year, the requirement applies to the three most recently completed financial years. At least six months must have elapsed since the end of the most recently completed financial year by the bid submission date. During the 60 months before the procurement commenced, the bidder must have properly completed at least three contracts for electrical construction works similar to this contract; at least one must have had a value of EUR 200,000 or more, excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address), and the reference number for public contracts. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder’s team must include a person with valid switching authorisations for the switching operations required on the 0.22–20 kV electricity network, excluding regional and distribution substations. For low-voltage work only (0.22–1 kV), at least low-voltage switching authorisation is required; otherwise, both low- and medium-voltage switching authorisations are required, including where medium-voltage switching is needed to carry out low-voltage work. The authorised person must be registered in Elektrilevi’s Partner Portal before the bid deadline. Applications for switching authorisations must follow procedure J387. The bidder must also have a person designated as responsible for the work operation, registered in the Partner Portal before the bid deadline. The bidder’s team must include a person leading electrical works who holds a valid A-level competence certificate and/or a qualification of at least level 6 under the Vocational Qualifications Act, has the relevant evidence by the bid submission date, and is registered in the Partner Portal before the deadline. The applicable requirements for these roles are set out in documents J31 and J3284. The bid must include the completed price table using the form in the procurement documents, with all unit-price fields filled in. The bidder must identify the contract signatory or signatories and provide their names, positions and contact details, as well as the name, position and contact details of the contract contact person. If the signatory’s authority is not established by the articles of association, a power of attorney must be provided. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must accept the procurement-document conditions without additions or qualifications. It must identify any information claimed as a trade secret and explain the basis; the price and other specified figures or indicators relevant to bid evaluation may not be treated as trade secrets. The bidder’s registered or residential location must not be in Russia or Belarus, and materials, equipment, goods and components installed or used in the works must not be produced in or originate from either country. The contracting authority may request certificates of origin. The standard payment period from receipt of the invoice is 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme entails a 95-calendar-day payment period. No award-scoring criteria are specified in the provided documents.
