Compliance requirements
The bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, its procurist or another person authorised to represent, decide for or control it, has been convicted of participation in a criminal organisation, breach of professional integrity or a corrupt act, fraud, terrorism-related offences, money laundering or terrorist financing, or of enabling unlawful employment of a foreign national or breach of the conditions for a foreign national’s employment in Estonia, including payment below the statutory minimum wage. Convictions relating to unlawful use of child labour or human trafficking are also grounds for exclusion. A bidder with outstanding state tax, levy or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, will be excluded.
The contracting authority may also exclude a bidder that has materially or repeatedly breached an essential term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty; or that has submitted false information about meeting qualification requirements or failed to provide required information or supplementary documents.
Businesses established in Russia or Belarus are not permitted to participate in the procurement.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 200,000 in each of the last three completed financial years. The bidder must provide extracts from the financial statements for those years showing the turnover, unless the information is publicly available to the contracting authority from a register. If the bidder’s financial year does not coincide with the calendar year, the requirement applies to its three latest completed financial years. At least six months must have passed since the end of the latest completed financial year by the bid submission date.
During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to this procurement. At least one contract must have had a value of EUR 60,000 or more, excluding VAT. The bidder must submit a list stating the performance period, the other contracting parties’ details, including the customer representative’s telephone number and email address, and procurement reference numbers where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must have a person responsible for managing electrical works who holds valid A-class competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. The person must hold the relevant evidence by the bid submission date and be registered in Elektrilevi’s Partner Portal (EPP) before bids are opened. The bidder must also have a worker with valid switching rights for work-related switching in the 0.22–20 kV network, excluding regional and distribution substations, registered in EPP before bids are opened. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side. The bidder must also have a person assigned responsibility for the work operation, with valid rights and registered in EPP before bids are opened.
The bid must comply with all tender document requirements; conditional bids and bids containing additional conditions are not permitted. The price must be submitted using the prescribed table, and every unit-price field must be completed. Preparation of the bid must also take account of the instructions for completing control-system document V178. The bidder must provide the names, titles and contact details of the person or persons authorised to sign the contract, and the contact person for contract matters. A power of attorney must be included if signing authority does not arise from the articles of association. The bidder must identify any trade secrets in the bid and explain why they qualify; the price and specified evaluation-related figures may not be designated as trade secrets.
The standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
Materials, equipment and goods, including components, installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. No award criterion is specified in the provided documents.
