Compliance requirements
A bidder may be excluded for relevant final convictions within the previous five years, or while an exclusion period remains in force, involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover breaches of tax or social security payment obligations; breaches of environmental, social or labour law obligations; bankruptcy, insolvency, liquidation, suspension of business or comparable situations; serious professional misconduct; agreements distorting competition; an unmanageable conflict of interest; involvement in preparing the procurement that gives an unremediable competitive advantage; significant or repeated breaches of earlier contracts resulting in termination, a price reduction, damages or a penalty; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procedure or obtain confidential information. National grounds include enabling an unlawfully staying foreign national to work or breaching conditions for foreign workers, being subject to an international or Estonian government sanction, and relevant tax-related convictions. Tax and social security arrears are assessed under the applicable rules; in Estonia, a tax debt below EUR 100 or a debt whose payment has been deferred is treated as described in the tender information. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
