Compliance requirements
The bidder may be excluded for final convictions within the previous five years, or a continuing exclusion period, involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and human trafficking. Other grounds include unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation, creditor arrangements, court administration of assets or suspended business activity; serious professional misconduct; agreements with other businesses to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremedied competitive advantage; and serious or repeated breaches of earlier contracts resulting in early termination, damages or comparable penalties. Exclusion may also follow from breaches of environmental, social or labour-law obligations, enabling the unlawful employment of a foreign national, or a conviction for tax offences. A bidder may be excluded for false or misleading information, failure to provide required information or documents, or attempts to improperly influence the procurement or obtain confidential information. A contract may not be awarded where doing so would breach applicable international or national sanctions. Where legally permitted and applicable to this procurement, the bidder may provide evidence of remedial measures demonstrating restored reliability. For Estonian tax debts, the notice notes that a tax-debt certificate is not issued for debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been deferred; foreign bidders are assessed under the law of their country of establishment.
