Compliance requirements
A bidder may be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, fraud, corruption, terrorist offences, money laundering or terrorist financing, illegal employment of a foreign national or violation of the conditions of a foreign national’s employment in Estonia, unlawful use of child labour or human trafficking. The conviction-related grounds apply where the conviction occurred within the preceding 5 years or an exclusion period imposed by the judgment is still in force. The bidder may be excluded for tax, payment or environmental charge arrears, or for unpaid social security contributions under the applicable rules. A bidder may also be excluded if awarding the contract would violate an international or Estonian government sanction, or if it is not entitled to participate under a restriction on the bidder’s place of establishment or residence set out in the procurement documents.
Each member of a joint bidding group must provide the required confirmations separately. If the bidder relies on another entity’s technical or professional capacity, the confirmations concerning exclusion grounds must also cover that entity.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least 2 contracts similar to this procurement during the 36 months preceding the start of the procurement. A similar contract must include the sale and installation of sports equipment for a sports facility, and each contract must have a value of at least EUR 20,000 excluding VAT. The bidder must provide a list showing each contract’s description, signing and completion dates, value excluding VAT, the client’s name, email address and telephone number, and, for public contracts, the procurement reference number. At the contracting authority’s request, the bidder must provide confirmation from the client that the contracts were properly performed. Any requested additional explanations, information or documents that are not readily available to the authority in public registers must be submitted within 5 working days of the request.
The offered goods must bear CE marking. The bidder must provide a detailed product specification, including all relevant information and technical characteristics, dimensions, manufacturer and model, together with photographs or drawings sufficient to assess compliance with the technical specification. World Athletics product certificates are required for the products identified in sections 3.1.1 and 3.1.2 of the technical specification. If equivalent products are offered, the bidder must provide evidence of equivalence, such as the manufacturer’s technical file, an authorised body’s test report, declarations or certificates, and a comparison table showing how the product meets each requirement.
The price must be submitted in the structure specified in the pricing schedule. Conditional bids are not permitted, and submission of a bid confirms acceptance of the procurement documents. For a joint bid, the joint bidders must appoint an authorised representative and submit the relevant power of attorney. The bidder must identify any claimed trade secrets and explain the designation; prices and other figures used in evaluating bids may not be designated as trade secrets. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions, and that neither the bidder nor persons acting on its behalf have engaged in corrupt conduct in this procurement. The available documents do not specify award criteria or their weighting; check the official procurement documents for those details.
