Compliance requirements
The bidder may be excluded for relevant final convictions of the company or its representatives within the applicable period, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable circumstances; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest or an advantage gained through involvement in preparing the procurement; significant or repeated failure to perform an earlier public contract; false or misleading information, withholding information, failure to provide requested documents, or improperly obtaining confidential information. National grounds also cover enabling a foreign national without a legal basis to work in Estonia, being subject to international sanctions, and relevant tax-crime convictions. The bidder is asked to disclose whether any ground applies. Where permitted, it may describe measures taken to restore its reliability. The stated tax-debt threshold is EUR 0; however, under the notice’s explanation, a tax-debt certificate is not issued for debt below EUR 100 or where payment has been rescheduled.
