Compliance requirements
The bidder may be excluded if it or its relevant management, supervisory or representative persons have qualifying convictions, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking, or tax offences. Exclusion grounds also include tax or social security payment arrears; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activities; serious professional misconduct; competition-distorting agreements; an unresolved conflict of interest or an unmitigated advantage from involvement in preparing the procurement; serious or repeated breaches of previous contracts resulting in early termination, damages or comparable sanctions; breaches of environmental, social or labour-law obligations; false or misleading information, withholding required information or documents, or improperly seeking confidential information or influencing the procurement; and employing a foreign national who is unlawfully present or working in Estonia. A bidder may also be excluded where entering into the contract would breach an international or Estonian government sanction. Where applicable, the bidder may provide evidence of measures taken to restore its reliability; the possibility of doing so depends on the applicable rules and tender documents.
Qualification criteria and exclusion grounds
The bidder must be the manufacturer’s official representative and provide the manufacturer’s confirmation of its representation and sales rights. From handover of the devices until the framework agreement ends, the bidder must provide an Estonian-speaking medical technology specialist trained by the manufacturer to maintain and repair the offered devices. The bidder must provide the specialist’s details and the manufacturer’s confirmation of the training.
The offer must include a maintenance plan for seven years of scheduled maintenance, stating the manufacturer-prescribed frequency, the complete list of work for each service, and the duration of each service. It must also include manufacturer’s product information supporting the technical specifications, such as the declaration of conformity, catalogues and information materials for the devices and all accessories, and user and maintenance manuals or other relevant technical documents. The bidder must complete all fields in the technical description and consumables offer form and submit the technical offer in accordance with that description. The price offer must follow the prescribed structure. Conditional offers are not permitted; submission confirms acceptance of the procurement documents. The bidder must provide contact details for the person authorised to sign the framework and procurement contracts, including evidence of authorisation where necessary, and for the contract contact person.
