Compliance requirements
The bidder may be excluded if the bidder, or a person in its management, supervisory or representative body, has a relevant final conviction within the previous five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion may also apply for breaches of tax or social security payment obligations, enabling a foreign national to work without a legal basis or in breach of employment conditions, and being subject to international sanctions. For tax debts, the notice explains that the Estonian tax authority does not issue a debt certificate where the relevant total debt is below EUR 100 or payment has been deferred; foreign bidders are assessed under the rules of their country of establishment.
