Compliance requirements
A bidder may be excluded if the bidder or a member of its administrative, management or supervisory body has, within the last five years, been convicted of participating in a criminal organisation, corruption, fraud, a terrorism-related offence, money laundering, terrorist financing, the illegal use of child labour or human trafficking. Other grounds may include failure to pay taxes or social security contributions, bankruptcy or other insolvency, liquidation, suspension of business, or breaches of environmental, social or labour-law obligations.
Further grounds include serious professional misconduct, agreements intended to distort competition, an unavoidable conflict of interest, involvement in preparing the procedure in a way that creates an unfair advantage, significant breach of a previous contract, submission of false information or failure to provide required information or documents. Grounds may also include enabling a foreign national to work without a legal basis, breaches of international sanctions, and convictions for tax offences. The stated threshold for tax and social security contribution arrears is EUR 0; however, the Estonian tax authority does not issue a tax-debt certificate where the debt is below EUR 100 or payment has been rescheduled.
Where an exclusion ground applies, the bidder may provide information on measures taken to restore its reliability if that possibility is available in the circumstances of the procurement.
