Compliance requirements
A bidder may be excluded if the bidder or a person in its management, supervisory or representative position has, within the previous five years or while an exclusion period remains in force, a final conviction for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include breaches of tax or social security payment obligations; bankruptcy, insolvency, liquidation or comparable proceedings; suspension of business; serious professional misconduct; anti-competitive agreements; an unresolved conflict of interest or involvement in preparing the procurement that creates an irremediable competitive advantage; and serious or repeated failures under previous contracts resulting in early termination, damages or comparable penalties.
Other grounds include breaches of environmental, social or labour obligations; submitting false or misleading information, withholding required information or failing to provide requested documents; improperly seeking confidential information or influencing the contracting authority; enabling the unlawful employment of a foreign national; being subject to applicable international sanctions; and, as a voluntary ground, a conviction for tax offences. The tax-debt threshold is EUR 0, with the stated national-law exception where the debt is below EUR 100 or payment has been deferred. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must confirm that its offer complies with all tender document requirements; conditional offers are not permitted. The offer must include contact details for the person authorised to sign the framework agreement and contract, and for the contract contact person. If authority to sign is based on a power of attorney, provide it.
The bidder must identify any trade secrets in its offer and explain why the information qualifies as such. Prices and other information used to evaluate the offer may not be designated as trade secrets.
The bidder must confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian citizens or residents, entities established in Russia, entities more than 50% owned by such persons or entities, or persons or entities acting on their behalf or instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
The bidder must have one medical equipment specialist, from delivery of the device until the end of the framework agreement, who has been trained by the manufacturer to maintain and repair the offered device. Provide the specialist’s details and manufacturer confirmation of the training. The bidder must be the manufacturer’s authorised representative and provide the manufacturer’s confirmation of its representation and sales rights.
Submit a four-year schedule of planned maintenance specifying the manufacturer-prescribed frequency, the complete list of maintenance tasks, and the duration of each maintenance visit. Include the product’s declaration of conformity, catalogues and information materials for the device and all accessories, user and maintenance manuals, technical data and other relevant manufacturer documentation supporting technical compliance. Complete and submit Annex I, the technical description/offer form, and provide the price in the structure set out in the pricing sheet.
