Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The contracting authority will exclude a bidder if any of the grounds in sections 95(1) or 95(4) of Estonia’s Public Procurement Act apply, including the ground in section 95(4)(8). The bidder must confirm that none of the specified grounds apply. The authority may verify exclusion grounds under section 96 of the Act, except for the procedure in subsection 1.

Qualification criteria and exclusion grounds

The bidder must have the right to offer the Nutanix manufacturer’s support services and software licences in Estonia. It must provide a copy of evidence of this right or a link to the manufacturer’s or partner’s website. If relying on a partner, the bidder must provide evidence that the partner is authorised by the manufacturer or evidence of cooperation between the partner and the bidder, or a link to the manufacturer’s website. The bid must be submitted by the bidder’s legal representative or an authorised representative. If submitted by an authorised representative, a signed power of attorney must be provided. Joint bidders must register as joint bidders in the procurement system, appoint an authorised representative, submit the power of attorney using the specified form, provide confirmation from each joint bidder that no exclusion grounds apply, and state the size and nature of each joint bidder’s share of the contract. The bid must comply with the procurement documents and must not be conditional. The bidder must submit the price using the required structure and complete all yellow-highlighted fields in the price form in Annex 3. If prices in Annex 3 and the pricing worksheet differ, the amount in Annex 3 will apply. Where equivalence is relevant, the bidder must explain it and provide supporting evidence. The bidder must also confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions. Any information identified as a trade secret must be justified; the bid price and other specified evaluation-related figures may not be designated as trade secrets. The documents provided do not specify financial-capacity, prior-experience or award-scoring requirements. Check the official tender documents for any further requirements and evaluation criteria.
