Compliance requirements
A tenderer will be excluded if it originates from a third country. For this procurement, third countries are countries that are not members of the European Union or the European Economic Area, parties to the World Trade Organization Agreement on Government Procurement, or countries with which the European Union has a reciprocal free trade agreement covering public procurement. The tenderer must state its country of origin, defined as the country where the company is registered.
A tenderer will also be excluded for outstanding tax arrears or overdue social security contributions. Tax debts that have been deferred or placed on an agreed payment schedule are acceptable. For tenderers established in Estonia, the contracting authority will check tax arrears directly with the Estonian Tax and Customs Board. Tenderers established outside Estonia must, if requested, provide evidence that they have no outstanding tax liabilities.
Qualification criteria and exclusion grounds
The tenderer’s average annual sales revenue for the last three completed financial years ending before the procurement procedure began must be at least EUR 2,000,000 per year. Tenderers must state their revenue for each year; the contracting authority will calculate the average. Tenderers established outside Estonia may be asked to provide signed financial statements or equivalent evidence.
During the 48 months before the procurement procedure began, the tenderer must have delivered at least two CNC fiber laser cutting machines, each with laser power of at least 6 kW and a working area of at least 3,000 × 1,500 mm. For each reference, provide the customer’s name, contract scope and value, contact details for the customer’s representative, and the acceptance month and year. The contracting authority may contact customers to verify the references. If the tenderer relies on another entity’s technical or professional capacity, that entity must perform the work or services to which the relevant capacity relates.
The tender must comply with the procurement documents; conditional tenders are not permitted. Joint tenderers must appoint an authorised representative and provide a power of attorney. Submit a price offer or bill of quantities showing the proposed solution, equipment specifications, scope of work and pricing structure. Complete the technical requirements form in Annex 1 and submit the required drawings, layout plan and other Annex 1 documents. Explain and provide supporting evidence for any claimed equivalence.
The offered warranty must be at least 12 months from acceptance, without an operating-hour limit that shortens the warranty period. It must cover two-shift operation of 8 working hours per shift (06:00–14:50 and 15:00–23:50) and remain valid without an additional service agreement. The tender must remain valid for at least one month from the submission deadline. The tenderer must unconditionally accept the payment schedule and terms and the contractual penalty provisions set out in the procurement documents.
For system malfunctions, the tenderer must provide an initial response within 8 hours of notification by email or telephone, carry out remote diagnostics where needed, and, if required, send an on-site technician to the buyer’s production premises within 24 hours of notification. These services must be included in the tender price during the warranty period. The penalty for each hour of delay in responding or arriving is EUR 800, capped at 5% of the total contract cost. The tenderer must install and commission the system and carry out successful acceptance testing at its own cost and risk.
The tenderer must identify any trade secrets in the tender and justify their classification. The total tender price and indicators used in evaluation may not be designated as trade secrets. Cut-quality assessment and cutting-parameter optimisation is optional: describe the offered functionality and required operator involvement if provided; its absence results in 0 points for that criterion but does not make the tender non-compliant. The award criteria and any further detailed requirements should be checked in the procurement documents.
