Compliance requirements
The tenderer must declare whether it, or its relevant managers, supervisory-body members or representatives, has been convicted within the last five years or remains subject to an exclusion period for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or child labour and other forms of human trafficking. Exclusion grounds also include unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activity; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be resolved; involvement in preparing this procurement that creates an unremovable competitive advantage; and serious or repeated breaches of earlier contracts leading to early termination, damages or comparable sanctions. Grounds further include failure to meet environmental, social or labour-law obligations; materially false or misleading information, withholding required information or documents, or improperly obtaining confidential information. National grounds include enabling the unlawful employment of a foreign national, contracting in breach of international or Estonian government sanctions, and relevant tax offences. The authority may request further evidence concerning a suspected sanctions-related ground. The tenderer may describe remedial measures to restore reliability where the law or procurement documents allow this. Tax and social-contribution arrears are assessed under the applicable rules; in Estonia, a tax-debt certificate is not issued for a debt below EUR 100 or where payment has been deferred.
