Compliance requirements
The bidder must declare whether it or its relevant managers, supervisory-board members or representatives have been convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also disclose tax or social-security contribution arrears; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, an analogous situation, an arrangement with creditors, administration of assets by a liquidator or court, or suspension of business; serious professional misconduct; agreements restricting competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unremovable competitive advantage; significant or persistent failures under previous contracts; false or misleading information, failure to provide required information or documents, or improper attempts to influence the procurement or obtain confidential information. The bidder must also declare whether it has enabled a foreign national to work without a lawful basis, whether it is subject to an international sanction, and whether contracting with it would breach an international or Estonian government sanction. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have provided technical maintenance services during the 36 months before the contract notice was published in the national procurement register for at least three buildings, each with more than 1,000 m² of enclosed net floor area. For each reference building, the bidder must have carried out all maintenance activities listed under EVS 807 codes 240, 250 and 270. The services must have been performed under concluded contracts and in accordance with good practice. Provide the contract list in the European Single Procurement Document, including the client’s name and contact details, the site address and contract period; if a contract resulted from a public procurement, include its reference number.
The services must be delivered with a project manager who has at least secondary education and either a relevant level 5 professional qualification—Property Manager, level 5, or Property Technical Maintenance Master, level 5, or an equivalent qualification—or the specified experience: during the three years before publication of the contract notice, having led technical maintenance at least twice for buildings with more than 1,000 m² of enclosed net floor area, with each assignment lasting at least six months. Submit the information required in Form 4 and evidence of education. For a qualification obtained outside Estonia, provide the qualification document and an Estonian competent authority’s confirmation that it is equivalent to the required qualification. The contracting authority may request evidence of project-management experience, such as client confirmation or a signed contract document.
The bid must accept the procurement-document requirements and explain and evidence any claimed equivalence. Submit the participation application using Form 2 and identify any confidential documents separately, with reasons. Submit the price in euros both in the procurement register’s evaluation worksheet and using Form 3, completing every field, including the fixed hourly rate for additional services, which must be within the stated limits. Cross-subsidisation between service prices and zero prices are not allowed, and fixed additional-service prices must not exceed the table’s maximum amounts. Include a binding price for the Rohuküla Harbour 8 option site. If bidding jointly, appoint a representative and submit the authorisation and joint-and-several-liability confirmation using Form 8. No specific award criterion or scoring formula is stated in the provided documents.
