Compliance requirements
The contracting authority will check whether the bidder, its management, administrative or supervisory body members, or persons authorised to represent it are subject to exclusion grounds relating to participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, unlawful use of child labour, or human trafficking. Relevant convictions from the past five years, or an exclusion period that is still in force, are covered. Where applicable, the bidder may provide evidence of measures taken to restore its reliability.
A breach of tax or social security contribution obligations is an exclusion ground. In Estonia, a tax debt certificate is not issued where the taxpayer’s total debt to the same tax authority is below EUR 100 or payment of the debt has been deferred; for a foreign bidder, the rules of its country of establishment apply. Exclusion also applies to conviction for enabling a foreign national residing in the country without legal grounds to work, or enabling a breach of the conditions for a foreign national’s employment in Estonia, and where awarding the contract would violate an international or Estonian Government sanction.
The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in the Russian Federation; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their direction.
