Compliance requirements
Exclusion grounds cover final convictions of the bidder or its representatives for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour, and human trafficking. They also include failure to pay taxes or social security contributions; insolvency, bankruptcy, liquidation, an arrangement with creditors, or suspended business activities; serious professional misconduct; agreements that distort competition; conflicts of interest; an unfair advantage arising from involvement in preparing the procurement; and significant breaches of previous contracts resulting in termination, compensation, or another sanction. Grounds may also arise from submitting false information, withholding information, failing to provide requested documents, or improperly obtaining or using confidential information.
Under Estonian law, grounds also include enabling a foreign national staying in Estonia unlawfully to work, or enabling a breach of the conditions of their employment; violation of an international sanction; and a conviction for a tax offence. The threshold for unpaid taxes and social security contributions is EUR 0. However, in Estonia, a tax debt certificate is not issued for debt below EUR 100 or where payment of the debt has been deferred. In certain cases, the bidder may provide evidence of measures taken to restore its reliability.
