Compliance requirements
A bidder may be excluded for relevant final convictions involving participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Grounds also include failure to pay taxes or social security contributions; bankruptcy, insolvency, liquidation or comparable circumstances; suspension of business; serious professional misconduct; anti-competitive agreements; an unmanageable conflict of interest; improper involvement in preparing the procurement; serious or persistent breach of an earlier contract; false or misleading information, withholding required information or failing to provide requested documents; and attempts to obtain confidential information or improperly influence the procurement. National grounds include enabling unlawful employment of a foreign national, being subject to international sanctions, and convictions for tax offences. A contract that would be void under applicable sanctions rules will not be awarded. Where permitted, the bidder may provide evidence of remedial measures to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must be registered in the Estonian Register of Economic Activities for electricity sales or hold an equivalent registration or licence required by the law of its country of establishment. The contracting authority will verify Estonian bidders’ registration in the public register; bidders established abroad must provide evidence of the relevant registration or licence. The bidder must also confirm that its tender complies with the procurement documents, is unconditional, and follows the required price-submission structure. Any claimed equivalence must be explained and supported by evidence. The offered electricity must not be subject to international sanctions or originate from a sanctioned region. The bidder must confirm that it will not use subcontractors or suppliers covered by the specified Russia-related restrictions for more than 10% of the contract value. Joint bidders must appoint an authorised representative and provide a power of attorney. Any information identified as a trade secret must be described and the designation justified; the price and evaluation-related figures may not be classified as trade secrets. No award-scoring details are provided in the supplied documents.
