Compliance requirements
The successful bidder must not be subject to any of the exclusion grounds set out in § 95(1) of the Estonian Public Procurement Act. The bidder must confirm that these grounds do not apply.
The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their direction. A tender that would result in a contract void under the applicable sanctions law will be rejected.
Qualification criteria and exclusion grounds
The bidder must have at least two operational, customer-facing offices or branches as of the tender submission deadline: at least one in Tallinn and at least one in Pärnu, Tartu or Viljandi. Each location must have a fixed address, provide real estate brokerage services and allow clients and prospective buyers to be received and advised, during published opening hours or by appointment. A registered address or virtual office without in-person customer reception does not qualify. The bidder must provide the addresses and confirm that the locations meet these requirements; the contracting authority may request supporting evidence.
The bidder must designate a project manager with a valid Level 6 Senior Real Estate Agent professional qualification and experience brokering commercial real estate sales. Relevant experience covers completed sales of office, commercial, production, warehouse or service buildings, and special-purpose properties, with a sale agreement concluded. The bidder must provide the project manager’s name, professional certificate number and details of the relevant experience.
The bidder must submit a sales management plan prepared in accordance with the contracting authority’s instructions and prescribed form. This plan will be evaluated; supplementary materials may be included and must be identified in the plan. The tender price must follow the prescribed structure. By submitting a tender, the bidder accepts the tender-document requirements; conditional tenders are not allowed. Where equivalence is relevant, the bidder must explain it and provide supporting evidence.
