Compliance requirements

The bidder must confirm that none of the exclusion grounds under section 95(1), points 1–5 of the Estonian Public Procurement Act applies to it. These grounds cover relevant convictions of the bidder or its representatives for participation in a criminal organisation, breach of duty, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to the illegal employment of foreign nationals, child labour or human trafficking; outstanding public tax, payment or environmental charges, or tax or social security contributions owed under the law of the country of establishment; and circumstances in which awarding the contract would breach an international or Estonian government sanction. The bidder must also confirm that it is not subject to the disqualification or exclusion grounds set out in section 6.3 of Eesti Energia AS’s and its group companies’ procurement rules.

Qualification criteria and exclusion grounds

For all four lots, the bidder must submit a completed goods offer form and provide its prices in the structure specified in the form. The bidder must confirm that its offer complies with the tender documents, accept a framework agreement without fixed quantities and confirm that it has reviewed the buyer’s rules and instructions published on its website. Conditional offers are not permitted. For each lot, the bidder must submit the completed offer form for that lot. For lots 1–4, the bidder must be registered in the commercial register or a similar register in its country of establishment if required by that country’s laws; the contracting authority will verify the registration of bidders established in Estonia.
