Compliance requirements
The contracting authority will exclude a bidder if the bidder or persons authorised to represent, control or make decisions for it have relevant convictions, including participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals or violations of their employment conditions, illegal use of child labour, or human trafficking. Bidders must also confirm that they have no overdue national tax, payment or environmental-charge liabilities, or equivalent tax or social-security debts under the law of their country of establishment, and that awarding the contract would not breach applicable international or Estonian government sanctions.
Where a bid involves a foreign entity through reliance on its capacity, a joint bid or subcontracting, the bidder must provide documents confirming that the foreign entity and relevant representatives have no applicable exclusion grounds when requested or as required by the tender documents. The bidder must also provide details of authorised representatives not identifiable from the company register; foreign bidders must provide supporting evidence concerning those persons.
The bidder must not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals or residents, entities established in Russia, entities more than 50% owned directly or indirectly by such persons or entities, or persons or entities acting on their behalf or under their direction. The offered goods must not be subject to international sanctions or originate from sanctioned regions. A bid that would result in a contract prohibited by sanctions will be rejected.
Qualification criteria and exclusion grounds
The following financial and technical qualification requirements apply to Lots 1–3:
- The bidder’s net turnover over its last three completed financial years with approved annual reports must total at least €9,000,000, with at least €3,000,000 in each year. These thresholds are not multiplied when bidding for more than one lot.
- During the 36 months preceding publication of the contract notice, the bidder must have properly performed at least one contract for the sale of 330 kV and/or 110 kV substation primary equipment, with a value of at least €100,000 excluding VAT. Only equipment delivered and accepted during that 36-month period counts. For framework agreements, completed orders under the framework count. One qualifying contract is sufficient even when bidding for multiple lots. The bidder must provide the contract description, customer name and contact details, contract dates, and value excluding VAT.
- If relying on another entity’s capacity, the bidder must provide that entity’s signed commitment, confirmation that it has no applicable exclusion grounds and agrees to the reliance, an explanation of its role in performing the contract, and confirmation of joint responsibility for proper performance. Foreign bidders or supporting entities must provide annual-report extracts or other documents establishing the required turnover.
For each lot, the bid must also include:
- A bid guarantee of €36,000 for Lot 1 and €12,000 for each of Lots 2 and 3. It may be a bank, financial institution or insurer’s guarantee, valid for the bid’s 90-day validity period and a further 30 days, or proof of payment of the deposited amount to the contracting authority’s account.
- Type-test reports for all offered equipment. If the equipment has not yet been type-tested, reports for a similar device from the same manufacturer and voltage class must be submitted, with RIP insulation compliance; verification of the offered device’s type test then takes place during contract performance. The applicable voltage ranges are Um 362–525 kV for 330 kV bushings, Um 245–300 kV for 220 kV bushings, and Um 123–145 kV for 110 kV bushings.
- Dimension drawings for all offered equipment, detailed enough to design the structural wall solution.
- A completed 031A high-voltage equipment specification questionnaire for all offered equipment, without substantive changes to the prescribed form, and the completed price schedule in euros excluding VAT, without substantive changes to its form.
- Confirmation that the equipment is new, unused, defect-free and compliant with the tender documents. Where an equivalent is offered, explain the equivalence and provide supporting evidence.
If the bid is submitted by someone other than the bidder’s legal representative, provide proof of authority. Foreign bidders must provide appropriate company-register or other evidence of the signatory’s authority. Joint bidders must appoint a representative, submit the joint-bidder authorisation and confirmation, and accept joint and several liability for contract performance. The notice documents provided do not specify an award criterion.
