Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder may be excluded if it or its relevant managers, directors, supervisory-body members or authorised representatives have, within the past five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking, or tax offences. Exclusion grounds also include unpaid taxes or social-security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, a similar situation, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements with other operators intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be avoided; and significant or persistent breach of a previous contract resulting in early termination, damages, a price reduction or a penalty. Grounds also include submitting false information, withholding required information or documents, failing to provide requested supporting documents promptly, improperly seeking confidential information or otherwise improperly influencing the procurement decision. A bidder may also be excluded for enabling the unlawful employment of a foreign national, being subject to an applicable international or Estonian government sanction, having an applicable local-tax arrear where this ground is stated in the tender documents, or being ineligible to submit a bid under the applicable restrictions. The notice sets the tax and social-contribution arrear threshold at EUR 0; the document notes that an arrear below EUR 100 or a deferred payment may not result in a tax-debt certificate being issued under Estonian rules. Where legally available for this procurement, a bidder affected by an exclusion ground may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must have completed, during the 36 months preceding publication of the contract notice, at least two contracts for preparing a shelter plan or an equivalent building safety plan (such as an emergency, fire-safety or security plan, or a risk analysis), or for designing shelters. The bidder must also have completed at least one contract for delivering safety training or training on the construction of shelters. The services must have been performed in accordance with the contracts and good practice. For each reference, provide the client and contact details, contract subject and term, and, where applicable, the procurement reference number. The bidder must have at least one responsible expert with a construction-sector professional qualification relevant to the service, or equivalent demonstrated competence enabling them to independently lead a comprehensive technical assessment of a building. For each mini-competition, provide the proposed expert’s details and, where required by the technical specification, those of any additional specialists. Confirm that the required specialists are available for the framework agreement. The bid must accept the tender-document conditions and must not be conditional. Submit unit prices and the total price in euros, excluding VAT, to two decimal places, using the structure in Annex 2 and the procurement register. Complete every line in Annex 2 without changes or added conditions; no work may be left unpriced and all totals must be provided. Zero or negative prices and cross-subsidisation outside the contract are not permitted. If the prices in Annex 2 and the register differ, the Annex 2 price will apply. Explain any claimed equivalence and provide supporting evidence. Identify any trade secrets in the bid and explain why they qualify, or state that the bid contains none; prices and evaluation-related numerical figures may not be designated as trade secrets. Provide the names and personal identification codes of authorised representatives not visible in the procurement register, or confirm that there are none. In a joint bid, appoint an authorised representative and include the power of attorney. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; entities more than 50% owned by such persons or entities; or representatives or persons acting on their instructions. The bidder must also confirm that neither it nor any entity whose capacity it relies on is established in Russia or Belarus. The submitted information does not specify an award criterion.
