Compliance requirements
The bidder must declare whether it, or a member of its management, supervisory or administrative body, or a person authorised to represent or control it, has a relevant final conviction within the last five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, and the specified domestic offences concerning illegal employment of foreign nationals and tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
The bidder may be excluded for unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable proceedings; an agreement with creditors; serious professional misconduct; environmental, social or labour-law violations; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unavoidable competitive advantage; or significant or repeated failures under earlier contracts resulting in early termination, damages or comparable sanctions. Exclusion may also apply where the bidder provided misleading information, withheld required information or documents, or improperly sought confidential information or influence over the procurement decision.
The bidder must confirm that awarding the contract would not breach applicable international or Estonian sanctions. It must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or established in Russia, are more than 50% owned by such persons or entities, or act on their behalf or instructions. Offered goods must not be subject to international sanctions or originate from sanctioned regions.
