Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must declare whether it, or a member of its management, supervisory or administrative body, or a person authorised to represent or control it, has a relevant final conviction within the last five years or remains subject to an exclusion period. The grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking, and the specified domestic offences concerning illegal employment of foreign nationals and tax offences. Where permitted, the bidder may provide evidence of measures taken to restore its reliability. The bidder may be excluded for unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation, suspended business activity or comparable proceedings; an agreement with creditors; serious professional misconduct; environmental, social or labour-law violations; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unavoidable competitive advantage; or significant or repeated failures under earlier contracts resulting in early termination, damages or comparable sanctions. Exclusion may also apply where the bidder provided misleading information, withheld required information or documents, or improperly sought confidential information or influence over the procurement decision. The bidder must confirm that awarding the contract would not breach applicable international or Estonian sanctions. It must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or established in Russia, are more than 50% owned by such persons or entities, or act on their behalf or instructions. Offered goods must not be subject to international sanctions or originate from sanctioned regions.

Qualification criteria and exclusion grounds

For each part, the bidder must have an online shop and, by the time the framework agreement is concluded, at least one permanent retail outlet in the relevant area with the full range of construction-supply product groups covered by the technical specification: Tallinn for Part 1; Jõhvi and/or Kohtla-Järve for Part 2; Tartu for Part 3; Kuressaare for Part 4. The online shop must allow the buyer to view products and prices, select goods and place orders, and must be in Estonian and/or English. The bidder’s total net turnover over the last three completed financial years must be at least EUR 400,000 for Part 1 and EUR 100,000 for each of Parts 2, 3 and 4. The bidder must provide the turnover figures in the procurement passport; the contracting authority may request the last three years’ financial statements or extracts if they are not available through a public database. The bid must comply with the procurement documents, and any claimed equivalence must be explained and supported by evidence. The bidder must submit a completed sample shopping basket showing retail prices valid on the date the contract notice was published, the discount percentage applicable to all product groups in scope throughout the framework agreement, and an extract from its sales or accounting system showing the sample-basket prices on that date. The price proposal must follow the structure specified in the procurement documents; conditional bids are not allowed. For a joint bid, the participants must appoint an authorised representative and include the relevant power of attorney. The bidder must identify and justify any information claimed as a trade secret; bid prices and other indicators used for evaluation may not be classified as trade secrets. The notice does not specify the detailed award-scoring criteria.
