Compliance requirements
The bidder may be excluded if it, or a member of its administrative, management or supervisory body or an authorised representative, has a final conviction within the past five years—or remains subject to an exclusion period—for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. The possibility of demonstrating restored reliability may apply where permitted for this procurement.
Exclusion grounds also include tax or social-security contribution debts. The stated threshold is EUR 0; under Estonian rules, a tax-debt certificate is not issued for debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been rescheduled. A bidder may show that the debt has been paid or is covered by a binding payment arrangement. Other stated national grounds are enabling a foreign national to work unlawfully, including paying below the statutory wage rate, and a contract award that would breach an international or Estonian Government sanction.
Qualification criteria and exclusion grounds
No specific qualification thresholds are stated in the available notice; check the tender documents for any further requirements. The bidder must submit an unconditional tender accepting the tender-document requirements and provide contact details for the person authorised to sign the framework and procurement contracts, including the basis of their authority and a power of attorney where applicable, as well as the contract-performance contact person. The bidder must identify any business secrets in the tender and explain why the information qualifies as such; tender prices and specified evaluation-related figures may not be classified as business secrets.
The tender must include the completed Annex I technical description/tender form and manufacturer’s information substantiating the technical details offered. Submit relevant conformity certificates, product catalogues, information materials, operating and maintenance instructions, technical data and other documents for the device and all accessories. The tender price must follow the structure in the “Evaluation criteria and assessable indicators” worksheet.
The bidder must confirm that it will not engage, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia; entities more than 50% directly or indirectly owned by such persons or entities; or persons or entities acting on their behalf or under their direction. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
