Compliance requirements
The tender passport requires declarations on exclusion grounds concerning final convictions of the bidder or its management, supervisory or authorised representatives within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or other forms of human trafficking. Other grounds include breaches of tax or social security payment obligations; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements, administration of assets by a liquidator or court, or suspended business activity; serious professional misconduct; agreements intended to distort competition; conflicts of interest that cannot otherwise be avoided; involvement in preparing the procurement that creates an unpreventable competitive advantage; early termination or sanctions for serious or repeated failures under previous contracts; similar situations under national law; and false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information or influence the procurement. The national grounds also include enabling the unlawful employment of a foreign national, being subject to an international sanction, and convictions for tax offences. The bidder must also confirm that it will not engage a subcontractor who would have to be replaced under the law. Where an exclusion ground applies, evidence of measures taken to restore reliability may be provided where legally permitted. For tax debt, the notice states that amounts below EUR 100 or debt under an approved payment schedule do not result in the tax authority issuing a tax-debt certificate.
Qualification criteria and exclusion grounds
The bidder must have net turnover of at least EUR 500,000 in each of the last two completed financial years. The bidder must provide the turnover figures in the ESPD; if they are not available in a public database, the contracting authority may request annual accounts, or extracts from them, for the last three financial years.
The chef responsible for providing the service must hold at least professional chef qualification level 3 or an equivalent qualification. The bidder must provide information about the chef’s qualification in the ESPD and, if requested by the contracting authority, submit documents proving it. This requirement also applies to a chef engaged as a subcontractor.
Prior familiarisation with the contract performance site is a prerequisite for submitting a bid. The bidder must arrange a visit in advance with the contracting authority’s contact person; a bid from a bidder that has not visited the site will not be considered. For a joint bid, a power of attorney appointing the joint bidders’ representative must be submitted, and the joint bidders are jointly and severally liable for performance of the contract.
The bid must be prepared in Estonian. Documents in other languages must be accompanied by an Estonian translation, for whose accuracy the bidder is responsible. The bidder must identify and justify any information claimed as a trade secret; the bid price and numerical indicators relevant to evaluation may not be classified as trade secrets. The bid must comply with the tender documents, include the required documents, follow the structure specified in the pricing and evaluated-indicators section, and be submitted in a commonly used file format. Conditional bids are not permitted. Any equivalent solution must be explained and supported by evidence.
The total usage fee for the cafes and sales points must be quoted for 48 months, to two decimal places. The minimum monthly fee is EUR 7.40 per square metre, plus all ancillary costs, taxes and charges related to use of the premises. The quoted price must include all costs of providing the service described in the tender documents and their annexes. By submitting a bid, the bidder confirms acceptance of all tender-document conditions.
The bidder must confirm that goods offered in providing the service are not subject to international sanctions and do not originate from sanctioned regions, that neither the bidder nor persons acting on its behalf have engaged in corrupt conduct in this procurement, and that it will not engage a subcontractor who must be replaced under the law. The bid must also include confirmation of compliance with the tender documents.
