Compliance requirements

Exclusion grounds will be checked in relation to the bidder and persons with management, supervisory or representation authority. These include final convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking. Checks also cover unpaid taxes or social security contributions, bankruptcy, insolvency, liquidation, suspended business activity, arrangements with creditors, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, false statements or failure to provide required information or documents, and breaches of environmental, social or labour-law obligations. Under Estonian law, checks additionally cover enabling a foreign national without a legal basis to work in the country, international sanctions and tax offences. The tax authority does not issue a tax-debt certificate where the debt is below EUR 100 or payment has been deferred. Where applicable under the governing rules, the bidder may provide evidence of measures taken to restore its reliability.

Qualification criteria and exclusion grounds

The bidder must confirm that its tender complies with the tender document requirements; conditional tenders are not permitted. If an offered solution is equivalent to a specified requirement, the bidder must explain the equivalence and provide supporting evidence. The tender price must follow the required structure and be entered in the price table, showing the unit price excluding VAT, quantity and total price. Prices must be stated in euros to no more than two decimal places. The bidder must confirm that it will not involve subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia; are directly or indirectly more than 50% owned by such persons or entities; or act on their behalf or under their direction. The bidder must also confirm that the goods offered are not subject to international sanctions and do not originate from a sanctioned region. For a joint tender, the members must appoint a representative and include an authorisation. The bidder must identify and justify any information designated as a trade secret; the tender price and figures used in the evaluation may not be designated as trade secrets. To enable checks of exclusion grounds, the bidder must provide the name and national identification number or date of birth of any person authorised to represent, make decisions for or control the bidder who is not shown in the relevant business register extract, or confirm that there are no such persons.
