Compliance requirements
The bidder must declare whether it or its relevant management, supervisory or representative persons are subject to exclusion grounds. These include final convictions within the relevant period for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the unlawful use of child labour or human trafficking. Other grounds include unpaid taxes or social-security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, a comparable situation under national law, assets administered by a liquidator or court, or suspended business activity; serious professional misconduct; agreements distorting competition; an unresolvable conflict of interest; involvement in preparing the procurement where this creates an unavoidable competitive advantage; serious or repeated failures under previous contracts resulting in early termination, damages or comparable sanctions; and false or misleading information, failure to provide required information or supporting documents, or improper attempts to influence the procurement or obtain confidential information. National grounds also cover enabling an unlawfully present foreign national to work and contracting with a person subject to international sanctions; relevant tax offences may also be grounds for exclusion. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least one contract or project during the past five years involving enterprise-development services and at least one of the following: developing companies’ export capacity; supporting digitalisation or the adoption of AI solutions; delivering training or mentoring for businesses; helping companies enter international markets; or connecting companies with buyers or other international business partners. For the reference, provide the project or contract name, a brief description, the service period, the client’s name and contact details, and the key experts involved. The bidder must provide at least a project manager, an export-development expert and an AI-solutions expert. The bid must identify these experts, describe their roles and provide information showing their relevant competence and experience. The team as a whole must be able to deliver the service in Ukrainian and English. No specific financial-capacity threshold is stated. The bid must comply with the tender documents, be unconditional and state its price in the prescribed structure. The bidder must also confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers that are Russian nationals, residents or entities established in Russia, are more than 50% owned by such persons or entities, or act on their behalf or under their instructions. The bidder must identify and explain any information claimed as a trade secret; the bid price and other specified evaluation-related figures may not be classified as trade secrets.
