Compliance requirements

The bidder must confirm that neither it nor its representatives, decision-makers or controllers have been convicted of participating in a criminal organisation, breach of professional integrity, corruption, fraud, terrorism or terrorist financing, money laundering, unlawful use of child labour, or human trafficking. The confirmation also covers enabling an illegally residing foreign national to work and violations of the conditions for employing a foreign national in Estonia, including paying less than the statutory minimum remuneration. The bidder must confirm that it has no outstanding national tax, duty or environmental charge debt, nor any tax or social security contribution debt under the law of its country of establishment, and that awarding the contract would not breach an international sanction or a sanction imposed by the Government of the Republic of Estonia. If a foreign entity participates in the bid, evidence that grounds for exclusion do not apply must be submitted with the bid for that entity, its management and supervisory board members, and other persons with authority to represent, make decisions for or control it. The contracting authority may request further evidence if it cannot verify the relevant matters through public registers.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the three financial years completed by the start of the procurement must total at least EUR 450,000 excluding VAT, with at least EUR 150,000 in each year. Consortium members may rely on one another’s figures. If the required information cannot be verified from public sources, or the bidder is registered abroad, the contracting authority may request extracts from annual accounts or other evidence. Within the 36 months preceding publication of the contract notice, the bidder must have duly performed at least one design contract covering either the preliminary design of at least 5 km of underground cable line at 110 kV or higher, or the detailed design of at least 5 km of underground cable line at 110 kV or higher. The contract must be worth at least EUR 50,000 excluding VAT, and at least EUR 50,000 must have been paid to the bidder under it. The contract may have started up to 60 months before publication of the notice and need not have been completed by then, but the required work must have been duly performed within the 36-month period. The bidder must provide the reference contract’s name and description, the client’s name and contact details, the contract period and its value. The contracting authority may request further evidence, including confirmation from the client. If relying on another entity’s resources, the bidder must submit that entity’s signed confirmation agreeing to the reliance, describing its participation in performing the contract and accepting joint responsibility for proper performance. The confirmation must also cover the absence of grounds for exclusion. The bid must include the completed price table using the form provided in the procurement documents, with prices in euros excluding VAT; substantive changes to the form are not permitted. A completed team CV form must also be submitted. A person submitting the bid who is not the bidder’s statutory representative must provide a power of attorney. Consortium members must appoint a representative from among themselves and are jointly and severally liable for performance of the contract. The bidder confirms that it accepts the procurement-document conditions, holds the necessary intellectual property and personal-data processing rights, and that the bid meets the technical requirements; any equivalence must be explained and supported with relevant evidence.
