Purchase of a Material Handling Machine

The notice identifies a national-law ground for exclusion where an economic operator is not entitled to submit a tender under the applicable procurement rules, including any restriction on participation based on the operator’s place of establishment set out in the tender documents. The bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals, residents or established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their instructions. A tender may be rejected if the resulting contract would be void under the applicable sanctions rules.

The bidder’s average annual turnover from sales of similar equipment must be at least EUR 300,000 over the last three financial years, 2023–2025. The bidder must have manufacturer-backed sales and servicing capability for the machine in Estonia and hold the relevant operating permit or licence. The bidder must submit the proposed machine’s complete technical description or documentation so that compliance with the technical requirements can be checked. The tender must follow the prescribed pricing structure, comply with the tender documents and be unconditional. If the bidder relies on equivalent solutions, it must explain the equivalence and provide supporting evidence. Joint bidders must appoint an authorised representative and include their power of attorney. The bidder must identify and justify any information claimed as a trade secret; the tender price and other specified evaluation-related figures may not be designated as trade secrets.
