Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing. The same applies to the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. Where required by the contract notice and tender documents, the bidder must also provide the relevant confirmations and evidence of electronic availability.
Qualification criteria and exclusion grounds
The bidder must have at least one responsible project manager for the design works who is a certified civil engineer (level 7) with specialisation in design management, preparation of building design projects or building design project expertise, or an equivalent qualification. The bidder must provide the project manager’s name, professional qualification and certificate number in the ESPD. If the bidder relies on another company’s resources to prove compliance, the other company’s ESPD must also be submitted. On request, the contracting authority may require documents proving the project manager’s professional qualification, whether the project manager is employed by the bidder or works as a subcontractor. The bidder’s project manager must have at least 5 years of design-related work experience and, during the 5 years before the notice was published, experience as responsible project manager in the design of at least one hospital building or building complex with a closed net area of at least 800 m², at least at preliminary design level. The building must have been issued a building permit or an equivalent document in the country where it is located. The bidder must submit the CV form in Annex 4 for the specialist involved. If the bidder relies on another company’s resources, the consent form in Annex 5 must be submitted. Joint bidders must appoint an authorised representative from among themselves and, if this is a joint bid, submit the joint bidders’ power of attorney. The bid must also include the required contact person details, the price form in Annex 2, and, if applicable, a short description of any business secret. The bidder must confirm that the bid complies with the tender documents and that the bid price is entered in the structure required on the pricing sheet. The bidder must also confirm that no subcontractors or suppliers accounting for more than 10% of the contract value are Russian nationals, residents, or entities established in the Russian Federation, or entities more than 50% owned by such persons or acting on their instructions.
