Compliance requirements
The exclusion grounds cover relevant convictions of the bidder or its representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, and child labour or human trafficking. A bidder may also be excluded for unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement where this creates an unavoidable competitive advantage; serious or repeated failures under previous contracts; false or misleading information, failure to provide required information or documents, or attempts to influence the procurement improperly. The national grounds also include enabling a foreign national to work unlawfully, tax-related offences, and international sanctions. Bidders established in Russia or Belarus are not permitted to participate. Restrictions also apply to certain Russian-linked subcontractors, suppliers and entities whose capacity is relied upon where their involvement exceeds 10% of the contract value.
Qualification criteria and exclusion grounds
The bidder must have provided, during the 36 months before publication of the contract notice, maintenance services for at least three buildings, each with a closed net floor area exceeding 2,000 m². Each reference must include maintenance activities under all EVS 807 codes 240, 250 and 270, performed under a contract and in accordance with good practice. The bid must list each contract, the client and contact details, the site address and contract period; include the procurement reference number where the contract resulted from a public procurement. At the contracting authority’s request, the bidder must provide the former client’s confirmation that the services were performed properly and to the required extent.
The services must be delivered with a project manager who has at least secondary education and either a relevant Estonian property-management or maintenance professional qualification at level 5 (or equivalent), or experience in the three years before publication leading maintenance work at at least two buildings with a closed net floor area exceeding 1,000 m², for at least six months per service. Submit Form 4 and proof of education. A qualification issued in Estonia will be checked in the public professional qualifications register; for a qualification obtained abroad, provide evidence of its recognition by the competent Estonian authority. Experience may be evidenced by client confirmation, a contract or a contract document signed by the client.
The bid must take over all procurement-document conditions and include the required participation statement (Form 2), a separately identified and justified list of documents claimed as trade secrets, and a completed price table (Form 3). Submit a separate price for each lot in euros, complete every relevant table field, and keep the fixed hourly rate within the stated limits. Cross-subsidising service prices and zero pricing are prohibited, and fixed prices for additional services may not exceed the table’s maximum amounts. For joint bids, appoint an authorised representative and submit the power of attorney and joint-and-several liability confirmation using Form 8. Confirm compliance with the applicable sanctions restrictions and that the bid meets the requirements, including evidence of equivalence where needed.
