Compliance requirements

The bidder must confirm that none of the exclusion grounds set out in § 95(1) of the Estonian Public Procurement Act apply. Grounds include convictions of the bidder, a member of its administrative, management or supervisory body, or a representative connected with the procurement for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment or breaching the conditions for employing a foreign national, including paying less than the statutory wage; and illegal use of child labour or human trafficking. Other grounds include outstanding taxes, duties or environmental charges, and an international sanction applying to the bidder or a member of its administrative, management or supervisory body. This requirement applies to all lots.

Qualification criteria and exclusion grounds

The procurement concerns a structural audit of the building at Vaksali 4 for Viljandi City Government. The bidder must appoint a specialist responsible for the audit or expert assessment who holds a level 7 professional qualification as a chartered civil engineer, or equivalent competence acquired abroad. A copy of the document proving the qualification must be included with the tender. If the contracting authority can verify the information in a publicly accessible database free of charge, the professional certificate number or the necessary personal details are sufficient. For a joint tender, the joint bidders must appoint an authorised representative from among themselves and include the power of attorney with the tender. The bidder must identify any trade secret in the tender and explain why it qualifies as such; the tender price and figures relevant to the award criteria may not be designated as trade secrets. The tender must comply with the tender documents and may not be conditional. The price must follow the structure specified for the procurement. Any claimed equivalence must be explained and supported with evidence.
