Compliance requirements
The bidder must confirm that no mandatory exclusion grounds apply. These include relevant final convictions of the bidder or its representatives for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, unlawful use of child labour or human trafficking, and enabling a person residing unlawfully in the country to work or breaching rules on a foreign national’s employment. Tax, environmental charge or social security contribution arrears are also grounds for exclusion.
The contracting authority may also exclude a bidder for a serious or persistent breach of an earlier public contract that resulted in termination, withdrawal, a price reduction, damages or a penalty, or for providing false information about compliance with qualification requirements or failing to provide requested supporting documents.
A bidder established in Russia or Belarus may not participate. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The bidder must provide the required confirmations and disclose any relevant circumstances.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 150,000 or more, excluding VAT. Submit a list stating each contract’s performance period, the other contracting party’s details (including a contact person’s telephone number and email address) and, for public contracts, the procurement reference number. The contracting authority may request evidence of proper completion. Use Form 4 for the contract information.
The bidder must also meet these personnel and offer requirements:
- Have a person responsible for the work operation, registered in Elektrilevi’s partner portal before bids are opened. The relevant instructions are set out in documents J31 and J3284.
- Have an electrical works manager with valid A-level electrical competence and/or a qualification of at least level 6, holding the relevant evidence at the time of bid submission and registered in the partner portal before bids are opened.
- Have a qualified construction engineer or construction manager, or a person with a construction-management qualification of at least level 6. Submit a copy of the professional certificate.
- Submit the completed price table (Form 1), with all required unit-price fields filled in, in euros excluding VAT. Do not alter any positions or quantities.
- Complete every field in the technical questionnaire for the 110 kV power transformer neutral earthing switch (Form 2).
- If subcontractors are used, submit Form 3 and a list of subcontractors. Provide the contract signatory’s name, title and contact details, the contact person for contract matters, and a power of attorney if signing authority is not established by the articles of association.
- Confirm that the bid meets the procurement documents; conditional bids are not allowed.
