Compliance requirements
The bidder must confirm that neither the company nor its management, supervisory bodies, authorised representatives or persons exercising control has been finally convicted within the last five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations, insolvency or liquidation proceedings, bankruptcy, suspension of business activities, serious professional misconduct, competition-distorting agreements, an unresolved conflict of interest, improper involvement in preparing the procurement, serious breaches of previous contracts, or a history of false or omitted information or failure to provide requested documents. The bidder must additionally confirm compliance with the national exclusion grounds concerning the employment of unlawfully staying foreign nationals, international sanctions and convictions for tax offences. Tax and social security arrears are assessed from EUR 0; the notice explains that tax debt certificates may not be issued for debt below EUR 100 or where payment has been deferred. Where applicable, the bidder must provide details of the circumstances, supporting evidence and any remedial measures demonstrating reliability.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capacity by having acted as the main contractor during the 60 months preceding the start of the procurement on at least two similar construction projects. Each project must have involved the complete demolition of one or more buildings with a closed net floor area exceeding 1,000 m², including demolition or reconstruction of external utility networks. The works must have been performed under concluded contracts and in accordance with good practice. The bidder must submit a list of the completed contracts, stating the building area, contract dates, client information and the client representative’s telephone number and email address; for public contracts, the procurement reference number must also be provided. The bidder or any joint bidders, and subcontractors directly participating in contract performance, must have a person qualified as a level 6 construction engineer or level 6 construction manager, specialising in building construction or general construction, with the relevant construction management or construction activity management competence. The bidder must provide the responsible person’s name, qualification and professional certificate number, and, on request, copies of the certificate and education documents and written confirmation of the person’s consent to act in that role. Equivalent documents issued under the law of the bidder’s country of establishment are accepted for foreign bidders. The bidder may rely on another undertaking’s capacity, but must provide the required information and a separate procurement passport for that undertaking where applicable. The bid must comply with the tender documents, must not be conditional, and must include the price in the required format and in the separate price table in Annex 2. Joint bidders must submit a power of attorney for their authorised representative. The bidder must identify and justify any trade secrets, confirm equivalence where relevant and confirm that it will not use a subcontractor who must be replaced under the applicable procurement legislation.
