Compliance requirements
The bidder must confirm that neither the bidder nor its representatives are subject to exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The bidder must also confirm that it has no tax or social security payment arrears, insolvency, bankruptcy, liquidation, suspended business activities, serious professional misconduct, competition-distorting agreements, unmanaged conflicts of interest, prohibited involvement in preparing the procurement, serious previous contract breaches or sanctions, or false or missing information submitted in procurement procedures. The bidder must comply with national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where applicable, the bidder must provide the requested explanations, evidence and information on remedial measures restoring its reliability.
Qualification criteria and exclusion grounds
The bidder must submit the participation declaration using Annex 4, Form II. The offered medicine must have a valid marketing authorisation in Estonia, and the bidder must hold a licence for wholesale distribution of medicinal products in Estonia. The contracting authority will verify these authorisations in the registers maintained by the State Agency of Medicines.
For each offered product, the bidder must submit the technical offer using Annex 1 in Excel format, stating the active substance, original product name, pharmaceutical form, dosage, manufacturer, unit price and total price. The offer must comply with the procurement documents; any proposed equivalent must be explained and supported by evidence of equivalence.
The bidder must submit the price information in the required evaluation-price structure and state the total price for the relevant lot exclusive of VAT. Prices must be in euros and include all costs for delivery and unloading at the Tartu University Hospital pharmacy at L. Puusepa 8, Tartu, and the Põlva Hospital pharmacy at Uus 2, Põlva. Unit prices are final and no additional payments or costs will be accepted. If a joint bid is submitted, the bidders must appoint an authorised representative and provide the power of attorney and confirmation of joint and several liability using Annex 4, Form I. The bidder must also identify and justify any trade secrets, without classifying the bid price or lot prices as trade secrets.
